Service Agreements

Services

Provider shall provide Client with the following services and/or products ("Services"):

 

Location and Delivery of Services

Location. Provider shall deliver Services to Client at the following location(s): Zoom

 

Privacy/YNAB Together

The Provider will maintain strict confidentiality with the Client's information and will not share any personal information of the Client without the Client's written permission.

If the Client chooses to share the Client’s budget using YNAB Together, the Provider agrees to not make changes to the Client’s budget without the Client's written consent. YNAB Together will be used by the Provider to review the Client’s budget and research questions provided by the Client.

 

Cost, Fees, and Payment

Payment is due before sessions begin.

 

Coaching Release

Consistency. The provider will use reasonable efforts to ensure the Client's desired Services are produced in a style and manner consistent with Provider's current services. However, the Client understands and agrees that:

  • Every client is different, with different financial situations, budgets, priorities, and needs.

  • The provider will use their coaching judgment when providing Services for the Client, which may not include strict adherence to the Client’s suggestions;

  • Dissatisfaction with Provider's judgment is not a valid reason for termination of this Agreement or request of any monies returned.

 

Limit of Liability

Maximum Damages. Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Provider.

Indemnification. Client agrees to indemnify, defend and hold harmless Provider for any injury, property damage, liability, claim, or other cause of action arising out of or related to Services and/or product(s) Provider provides to Client.

 

Cancellation, Rescheduling, and No-Shows for One-on-One Coaching

Cancellation, Rescheduling of Services, or No-Show Client.  Rescheduling may be necessary by the Provider or Client.  Both parties agree to notify the other immediately if rescheduling needs to occur and work together to reschedule in a timely manner.

 

Impossibility

Failure to Perform Services. In the event Provider cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:

1.     Immediately give Notice to Client; and

2.     Excuse Client(s) of any further performance and/or payment obligations in this Agreement.

 

General Provisions

Disclaimers.  The provider is a YNAB Certified Budgeting Coach, which means that they have been trained to coach people on using YNAB software and the YNAB budgeting method.  The provider has met the select requirements of You Need a Budget LLC in order to receive this certification, which means that they have the ability to competently coach YNAB to others.  The provider is not an employee of YNAB, and all non-YNAB-related opinions and recommendations are their own.  The views of the provider do not reflect the views of YNAB and its employees or its affiliates.  

The provider is not a financial advisor, lawyer, or professional counselor.  The information they provide is for coaching and teaching purposes, and the provider assumes no responsibility for the actions the client takes based on that coaching and teaching.

The services provided do not include the YNAB subscription cost.  All costs associated with a YNAB subscription are the responsibility of the client.

Amendment. The parties may amend this Agreement only by the parties’ written consent via proper Notice.
